1 Quiconque procède à une imprégnation ou à un développement jusqu’au stade d’embryon en utilisant du matériel germinal provenant d’un embryon ou d’un fœtus est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.
2 Quiconque aliène ou acquiert à titre onéreux du matériel germinal humain et des produits résultant d’embryons ou de fœtus est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.
3 Si l’auteur agit par métier, la peine est une peine privative de liberté de trois ans au plus ou une peine pécuniaire. En cas de peine privative de liberté, une peine pécuniaire est également prononcée.

1 Any person who uses reproductive material obtained from an embryo or foetus to bring about impregnation or further development into an embryo shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.
2 Any person who purchases or sells human reproductive material or products derived from embryos or foetuses shall be liable to custodial sentence not exceeding three years or to a monetary penalty.
3 If the offender acts in a professional capacity, the penalty shall be a custodial sentence not exceeding three years or to a monetary penalty. A custodial sentence must be combined with a monetary penalty
