784.10 Telecommunications Act of 30 April 1997 (TCA)
Art. 15 Conditions d’octroi de la concession
Quiconque veut obtenir une concession de service universel doit:
- a.
- disposer des capacités techniques nécessaires;
- b.48
- rendre vraisemblable qu’il est en mesure d’assurer l’offre de services, notamment du point de vue financier, ainsi que l’exploitation pendant toute la durée de la concession, et indiquer quelle compensation financière selon l’art. 19 il entend obtenir;
- c.
- garantir qu’il respectera le droit applicable en la matière, notamment la présente loi et ses dispositions d’exécution ainsi que la concession;
- d.49
- garantir qu’il respectera le droit du travail et observera les conditions de travail usuelles dans la branche.
Art. 15 Conditions for granting the licence
Any person wishing to obtain a universal service licence must:
- a.
- have the necessary technical capacities;
- b.48
- furnish convincing proof that the service can be offered, particularly with regard to finance, and the service operated for the entire duration of the licence, and state what financial compensation, in accordance with Article 19, will be required;
- c.
- undertake to comply with the applicable legislation, in particular this Act and its implementing provisions, and the licence conditions;
- d.49
- undertake to comply with employment legislation and to guarantee the working conditions that are customary in the sector.
