Art. 24

1 Les cantons veillent à assurer la surveillance de la formation professionnelle initiale.

2 L’encadrement, l’accompagnement des parties aux contrats d’apprentissage et la coordination des activités des partenaires de la formation professionnelle initiale font partie de la surveillance.

3 Font de surcroît l’objet de la surveillance notamment:

a.
la qualité de la formation à la pratique professionnelle, y compris celle de la formation dispensée dans les cours interentreprises et d’autres lieux de formation comparables;
b.
la qualité de la formation scolaire;
c.
les examens et les autres procédures de qualification;
d.
le respect des dispositions légales du contrat d’apprentissage;
e.
le respect du contrat d’apprentissage par les parties.

4 Sur proposition commune du prestataire de la formation professionnelle et de la personne en formation, le canton arrête des décisions portant sur:

a.
l’équivalence des formations professionnelles non formelles visées à l’art. 17, al. 5;
b.
les cas visés à l’art. 18, al. 1.

5 Dans le cadre de la surveillance, les cantons peuvent notamment:

a.
exiger la rétrocession, partielle ou totale, des montants qu’ils ont transmis à des tiers en vertu de l’art. 52, al. 2, 2e phrase;
b.
annuler un contrat d’apprentissage.

Art. 24

1 The Cantons shall be responsible for overall supervision of VET programmes.

2 Supervisory activities shall comprise the provision of guidance and suggestions to parties to the apprenticeship contract as well as overall coordination between the VET participants.

3 Supervisory activities shall also include the following:

a.
ensuring the quality of workplace training, including branch courses or similar third-party training courses;
b.
ensuring the quality of the classroom instruction segment of VET programmes;
c.
monitoring examinations and other qualification procedures;
d.
ensuring that apprenticeship contracts are in line with statutory provisions;
e.
ensuring that contracting parties abide by the terms of their apprenticeship contracts.

If a joint request is made by education and training providers and the learners, the Cantons shall decide on the following matters:

a.
validation of non-formal learning under Article 17 paragraph 5;
b.
cases referred to in Article 18 paragraph 1.

5 Within the framework of their supervisory activities, the Cantons may:

a.
claim back all or part of the federal funding given to the third parties referred to in Article 52 paragraph 2 sentence 2;
b.
terminate an apprenticeship contract.
