1 Les prétentions pour cause d’enrichissement illégitime sont régies par le droit qui régit le rapport juridique, existant ou supposé, en vertu duquel l’enrichissement s’est produit.
2 À défaut d’un tel rapport, ces prétentions sont régies par le droit de l’État dans lequel l’enrichissement s’est produit; les parties peuvent convenir de l’application de la loi du for.
1 Claims for unjust enrichment are governed by the law which governs the existing or assumed legal relationship on the basis of which the enrichment occurred.
2 In the absence of such a relationship, the claims are governed by the law of the state in which the enrichment occurred; the parties may agree to the application of the law of the forum.
