1 Le contrat de travail est régi par le droit de l’État dans lequel le travailleur accomplit habituellement son travail.
2 Si le travailleur accomplit habituellement son travail dans plusieurs États, le contrat de travail est régi par le droit de l’État de l’établissement ou, à défaut d’établissement, du domicile ou de la résidence habituelle de l’employeur.
3 Les parties peuvent soumettre le contrat de travail au droit de l’État dans lequel le travailleur a sa résidence habituelle ou dans lequel l’employeur a son établissement, son domicile ou sa résidence habituelle.
1 Employment contracts are governed by the law of the state in which the employee habitually performs their work.
2 If the employee habitually performs their work in several states, the employment contract is governed by the law of the state of the establishment or, in the absence of an establishment, of the domicile or habitual residence of the employer.
3 The parties may submit the employment contract to the law of the state in which the employee has their habitual residence or in which the employer has their establishment, domicile or habitual residence.
