1 Si, dans l’exécution d’un accord international, il est constaté qu’une restriction à la concurrence est incompatible avec l’accord, le DEFR peut, d’entente avec le Département fédéral des affaires étrangères, proposer aux parties concernées un accord amiable en vue de la suppression de l’incompatibilité.
2 Si un accord amiable ne peut être réalisé à temps et qu’une partie à l’accord international menace de prendre des mesures à l’encontre de la Suisse, le DEFR peut, d’entente avec le Département fédéral des affaires étrangères, ordonner les mesures nécessaires à la suppression de la restriction à la concurrence.
1 If in implementing an international agreement, it is found that a restraint of competition is incompatible with that agreement, the EAER may in consultation with the Federal Department of Foreign Affairs propose an amicable settlement to the parties involved so as to eliminate the incompatibility.
2 If an amicable settlement cannot be reached in time and one party to the agreement threatens to take protective measures against Switzerland, the EAER may in consultation with the Federal Department of Foreign Affairs determine the measures necessary to eliminate the restraint of competition in a ruling.
