1 Les produits protégés par un brevet, ou leur emballage, peuvent être munis du signe du brevet qui se compose de la croix fédérale et du numéro du brevet. Le Conseil fédéral peut prescrire des indications supplémentaires.37
2 Le titulaire du brevet peut exiger de ceux qui ont le droit d’utiliser son invention, en vertu d’un usage antérieur ou d’une licence, qu’ils apposent le signe du brevet sur les produits qu’ils fabriquent ou sur leur emballage.
3 S’ils ne se conforment pas à la demande du titulaire du brevet, ils répondent envers lui du dommage qui en résulte, sans préjudice du droit du titulaire du brevet d’exiger l’apposition du signe.

1 Products that are protected by a patent, or their packaging, may be marked as being patented with the Federal Cross and the number of the patent. The Federal Council may prescribe additional indications.38
2 The proprietor of the patent may require any prior user or any licensee to affix the patent mark on the products manufactured by them or on the packaging of such products.
3 If the prior user or licensee does not comply with the requirement of the proprietor of the patent, he is liable to the latter for any resulting losses without prejudice to the proprietor’s right to require the use of the patent mark.
