Lorsque l’entreprise ou une partie de celle-ci est transférée à un tiers durant un sursis concordataire dans le cadre d’une faillite ou dans celui d’un concordat par abandon d’actifs, les rapports de travail passent à l’acquéreur avec tous les droits et les obligations qui en découlent pour autant que ce transfert ait été convenu avec l’acquéreur et que le travailleur ne s’y oppose pas. Pour le reste, les art. 333, à l’exception de l’al. 3, et 333a sont applicables par analogie.

If the company or part thereof is transferred during a debt restructuring moratorium, in the course of bankruptcy proceedings or under a composition agreement with assignment of assets, the employment relationship with all rights and obligations is transferred to the acquirer if this has been agreed with the acquirer and the employee does not object to the transfer. In addition, Article 333, with the exception of its paragraph 3, and 333a apply mutatis mutandis.
