152.3 Federal Act of 17 December 2004 on Freedom of Information in the Administration (Freedom of Information Act, FoIA)
Art. 18 Tâches et compétences
En vertu de la présente loi, le Préposé fédéral à la protection des données et à la transparence (préposé) selon l’art. 26 LPD10 a en particulier les tâches et compétences suivantes:
- a.
- conduire la procédure de médiation (art. 13) et formuler une recommandation (art. 14) lorsque la médiation n’aboutit pas;
- b.
- informer d’office ou à la demande de particuliers ou d’autorités sur les modalités d’accès à des documents officiels;
- c.
- prendre position sur les projets d’actes législatifs fédéraux ou les mesures de la Confédération qui touchent fondamentalement au principe de la transparence.
Art. 18 Duties and Competencies
The Federal Data Protection and Information Commissioner (the Commissioner) pursuant to Article 26 of the Data Protection Act10 shall, in particular, have the following duties and competencies under the present Act:
- a.
- conducting mediation proceedings (Art. 13) and making a recommendation (Art. 14), should mediation not succeed;
- b.
- providing information ex officio, or at the request of individuals or authorities, on the modalities governing access to official documents;
- c.
- commenting on draft legislation and measures of the Federal Government which have a fundamental impact on the principle of freedom of information.
