1 Les organisations qui sont constituées depuis deux ans au moins et qui ont pour tâche, en vertu de leurs statuts, de promouvoir l’égalité entre femmes et hommes ou de défendre les intérêts des travailleurs ont qualité pour agir en leur propre nom en vue de faire constater une discrimination, lorsqu’il paraît vraisemblable que l’issue du procès affectera un nombre considérable de rapports de travail. Avant d’ouvrir la procédure de conciliation ou d’introduire action, ces organisations doivent donner à l’employeur concerné la possibilité de prendre position.
2 Pour le surplus, les dispositions régissant les actions intentées à titre individuel sont applicables par analogie.
1 Organisations that have been in existence for at least two years and that have as their object in terms of their articles of incorporation the promotion of gender equality or safeguarding the interests of employees may in their own names have a finding of discrimination declared if the probable outcome of proceedings will have an effect on a considerable number of jobs. They must allow the employer concerned the opportunity to state his position before they institute conciliation proceedings or bring an action.
