Art. 78 Protection de la nature et du patrimoine

1 La protection de la nature et du patrimoine est du ressort des cantons.

2 Dans l’accomplissement de ses tâches, la Confédération prend en considération les objectifs de la protection de la nature et du patrimoine. Elle ménage les paysages, la physionomie des localités, les sites historiques et les monuments naturels et culturels; elle les conserve dans leur intégralité si l’intérêt public l’exige.

3 Elle peut soutenir les efforts déployés afin de protéger la nature et le patrimoine et acquérir ou sauvegarder, par voie de contrat ou d’expropriation, les objets présentant un intérêt national.

4 Elle légifère sur la protection de la faune et de la flore et sur le maintien de leur milieu naturel dans sa diversité. Elle protège les espèces menacées d’extinction.

5 Les marais et les sites marécageux d’une beauté particulière qui présentent un intérêt national sont protégés. Il est interdit d’y aménager des installations ou d’en modifier le terrain. Font exception les installations qui servent à la protection de ces espaces ou à la poursuite de leur exploitation à des fins agricoles.

Art. 78 Protection of natural and cultural heritage

1 The protection of natural and cultural heritage is the responsibility of the Cantons.

2 In the fulfilment of its duties, the Confederation shall take account of concerns for the protection of natural and cultural heritage. It shall protect the countryside and places of architectural, historical, natural or cultural interest; it shall preserve such places intact if required to do so in the public interest.

3 It may support efforts made for the protection of natural and cultural heritage and acquire or preserve properties of national importance by contract or through compulsory purchase.

4 It shall legislate on the protection of animal and plant life and on the preservation of their natural habitats and their diversity. It shall protect endangered species from extinction.

5 Moors and wetlands of special beauty and national importance shall be preserved. No buildings may be built on them and no changes may be made to the land, except for the construction of facilities that serve the protection of the moors or wetlands or their continued use for agricultural purposes.
