Art. 23a Transparency

1 The operator shall publicly disclose key aspects of all information relating to the financial market infrastructure on a regular basis, in particular:

a.
the design and operation of the financial market infrastructure;
b.
the operator’s organisational structure;
c.
the rights and obligations of the participants;
d.
the participation requirements as well as the criteria for the suspension and exclusion of a participant;
e.
the rules and procedures in the event of a participant’s default;
f.51

the aggregate transaction volumes and amounts;
h.52

i.
the prices and fees charged by the financial market infrastructure for the services it offers, including its conditions for discounts.

2 The operator shall publish information in accordance with the standards set by the relevant international bodies.

Art. 23a Trasparenza

1 L’esercente pubblica regolarmente in sintesi tutte le informazioni essenziali concernenti l’infrastruttura del mercato finanziario, e in particolare:

a.
le modalità di funzionamento dell’infrastruttura del mercato finanziario;
b.
la struttura organizzativa dell’esercente;
c.
i diritti e gli obblighi dei partecipanti;
d.
i presupposti per la partecipazione e i criteri per la sospensione e l’esclusione di un partecipante;
e.
le regole e le procedure previste in caso di inadempienza di un partecipante;
f.51

g.
i volumi e gli importi aggregati delle transazioni;
h.52

i.
i prezzi e le tasse richiesti per i servizi prestati dall’infrastruttura del mercato finanziario, nonché le condizioni per la concessione di riduzioni.

2 L’esercente pubblica informazioni in conformità con le direttive emanate dai competenti organi internazionali.
