Art. 17

1 If the article submitted for controlling does not satisfy the legal minimum fineness or if the fineness mark stamped on the article does not match the actual fineness, the Assay Office shall refuse to grant its official hallmark and shall notify the Central Office, which shall order a second opinion.

2 Depending on the outcome of the second opinion, the Central Office shall either authorise the official hallmarking or it shall have the articles seized and shall file a criminal complaint.

3 If the objection is justified but no offence appears to have been committed, the Central Office shall take the steps necessary for the further processing of the articles in question, which may not be placed on the market in Switzerland. The costs thereby incurred are borne by the party submitting the article for controlling. The Central Office may order the destruction of the articles.

Art. 17

1 Se dal controllo risulta che il lavoro presentato non ha il titolo minimo prescritto dalla legge o che il suo titolo reale è diverso da quello indicato sull’oggetto, la marchiatura ufficiale sarà rifiutata, avvertendone in pari tempo l’Ufficio centrale, che ordina una controperizia.

2 Secondo il risultato di questa controperizia l’Ufficio centrale ordina la marchiatura ufficiale oppure il sequestro; in quest’ultimo caso esso sporge denunzia all’autorità competente.

3 Se, nonostante la fondatezza della contestazione, non è da ritenere che vi sia stato un reato, l’Ufficio centrale dà le disposizioni necessarie su quel che bisogna fare di questi lavori di cui non si può permettere il libero commercio nel Paese. Le spese richieste da questi provvedimenti devono essere rimborsate da colui che presenta il lavoro al controllo. L’Ufficio centrale può ordinare la distruzione dei lavori.
