Art. 31 Requirements with regard to the company

¹ Prior to contracting with a company, the contracting authority shall ascertain that the company in question meets the following requirements:

a.

it is able to provide the required guarantees concerning the recruitment, training, and oversight of its personnel;

b.

its good reputation and irreproachable conduct in business are attested to both by its adherence to the Code of Conduct²³ and compliance with the provisions therein and, in particular, by:

1.: experience in the field,
2.: references, or
3.: membership of a professional association;

c.

it is solvent;

d.

it has an adequate internal control system which ensures that its personnel comply with established standards of conduct and that disciplinary measures are taken where misconduct occurs;

e.

it is authorised under the applicable law to carry out activities in the domain of private security;

f.

it has liability insurance coverage in an amount commensurate with the risk incurred.

² The contracting authority may, by way of exception, contract with a company that does not possess liability insurance coverage, where:

a.: purchasing such insurance would engender disproportionate costs to the company; and
b.: the liability risk and the amount of any compensatory damages to be borne by the Confederation may be assessed as low.

Art. 31 Requisiti delle imprese

¹ Prima di impiegare un’impresa, l’autorità committente deve assicurarsi che questa:

a.

offra le garanzie necessarie per quanto concerne il reclutamento, la formazione e il controllo del suo personale;

b.

abbia una buona reputazione e una pratica d’affari impeccabile, comprovate dall’adesione al Codice di condotta²³ e dal rispetto delle sue disposizioni, nonché in particolare:

1.: dalle esperienze maturate sul campo,
2.: dalle referenze, o
3.: dall’affiliazione a un’associazione professionale;

c.

sia solvibile;

d.

disponga di un meccanismo di controllo interno adeguato che garantisca il rispetto delle norme di comportamento da parte del personale e che preveda misure disciplinari in caso di violazione;

e.

sia autorizzata a esercitare un’attività nel campo della sicurezza privata conformemente al diritto applicabile;

f.

abbia stipulato un’assicurazione di responsabilità civile per un importo corrispondente al rischio assunto.

² L’autorità committente può eccezionalmente impiegare un’impresa che non ha concluso un’assicurazione di responsabilità civile se:

a.: la conclusione di una simile assicurazione causerebbe spese sproporzionate all’impresa; e
b.: il rischio per la Confederazione di incorrere in una responsabilità e l’importo di eventuali risarcimenti dei danni sono considerati esigui.
