Art. 6 Cooperation between the federal authority and the cantons

1 If the Confederation is responsible for the deforestation permit, the cooperation between the FOEN and the cantons is subject to Article 49 paragraph 2 ForA. The cantons shall support the federal authorities in the clarification of the facts.

2 Included in the calculation of the deforestation area, based on which the obligation to hear the FOEN (Art. 6 para. 2 ForA) is determined, are all deforestation areas that:

a.
are included in the deforestation application;
b.
were deforested for the same works in the 15 years previous to the submission of the deforestation application, or for which deforestation is still allowed.

Art. 6 Collaborazione tra l’UFAM e i Cantoni

1 Se la Confederazione è competente per autorizzare il dissodamento, la collaborazione dell’UFAM e dei Cantoni è retta dall’articolo 49 capoverso 2 LFo. I Cantoni sostengono le autorità federali nell’accertamento dei fatti.

2 Per il calcolo della superficie di dissodamento, determinante per l’obbligo di consultare l’UFAM (art. 6 cpv. 2 LFo), si sommano tutti i dissodamenti:

a.
chiesti nella domanda di dissodamento;
b.
eseguiti per la stessa opera durante i 15 anni precedenti la domanda, o che possono essere ancora eseguiti.

8 Nuovo testo giusta il n. II 17 dell’O del 2 feb. 2000 relativa alla LF sul coordinamento e la semplificazione delle procedure d’approvazione dei piani, in vigore dal 1° mar. 2000 (RU 2000 703).
