Art. 2 Duties of the operator

1 Solarium operators must ensure that:

a.
solariums for users are visibly classified as UV type 1, 2, 3 or 4 in accordance with Annex 1 Number 1;
b.
the total erythemal effective irradiance of a solarium, taking into account the maximum values of the radiation components given in Annex 1 Number 1, does not exceed 0.3 watt per square metre;
c.
a device-specific irradiation plan in accordance to Annex 1 Number 2 shall be made available to the users;
d.
UV protective goggles of the type specified by the solarium manufacturer are available;
e.
users may only use a solarium of UV type 4 if they present a medical certificate to the staff.

2 The operator must equip and operate the solarium in such a way that:

a.
persons aged under 18 years cannot use the solarium;
b.
the users can easily set the parameters of the exposure schedule on the solarium.

3 The operator, prior to the users using the solarium, must:

a.
inform them that risk groups, as specified in Annex 1 Number 3, must not use a solarium under any circumstances;
b.
explain the dangers of UV irradiation as listed in Annex 1 Number 4, as well as measures to minimise these dangers.

Art. 2 Obblighi del gestore

1 Il gestore di un solarium deve assicurare che:

a.
i solarium siano classificati in modo ben visibile per gli utenti come UV tipo 1, 2, 3 o 4 secondo l’allegato 1 numero 1;
b.
l’irradianza efficace totale di un solarium, in considerazione dei valori massimi delle bande dello spettro ad azione eritematogena di cui all’allegato 1 numero 1, non superi il valore di 0,3 Watt per metro quadrato;
c.
agli utenti sia messo a disposizione un programma di esposizione specifico dell’apparecchio secondo l’allegato 1 numero 2;
d.
siano presenti occhiali di protezione UV del tipo designato dal fabbricante del solarium;
e.
gli utenti utilizzino un solarium UV tipo 4 solo se presentano una raccomandazione medica al personale.

2 Deve predisporre e gestire il solarium in modo che:

a.
le persone di età inferiore ai 18 anni non possano utilizzarlo;
b.
gli utenti possano regolare facilmente sul solarium le impostazioni prescritte dal programma di esposizione.

3 Deve informare gli utenti prima dell’utilizzo del solarium:

a.
che i gruppi a rischio di cui all’allegato 1 numero 3 non possono utilizzare in alcun caso un solarium;
b.
sui pericoli dei raggi UV elencati nell’allegato 1 numero 4 e sulle misure per ridurre al minimo tali pericoli.
