Art. 28 Data protection period

1 For data submitted to the Notification Authority in accordance with this Ordinance, the following protection periods apply:

a.
for data submitted with a view to the approval of an existing active substance: 10 years from the first day of the month following the date of the approval of the relevant active substance for the particular product type by the European Commission in accordance with Article 9 of Regulation (EU) No 528/2012138;
b.
for data submitted with a view to the approval of a new active substance: 15 years from the first day of the month following the date of the approval of the relevant active substance for the particular product type by the European Commission in accordance with Article 9 of Regulation (EU) No 528/2012;
c.
for data submitted with a view to the renewal or review of the approval of a new active substance: 5 years from the first day of the month following the date of the renewal or review of the approval by the European Commission in accordance with Article 14 paragraph 4 of Regulation (EU) No 528/2012;
d.
for data submitted with a view to the authorisation of a biocidal product containing only existing active substances: 10 years from the first day of the month following the date of the authorisation by the Notification Authority or by the competent authority in accordance with Regulation (EU) No 528/2012;
e.
for data submitted with a view to the authorisation of a biocidal product containing a new active substance: 15 years from the first day of the month following the date of the authorisation by the Notification Authority or by the competent authority in accordance with Regulation (EU) No 528/2012;
f.
for data submitted with a view to the renewal or amendment of the authorisation of a biocidal product: 5 years from the first day of the month following the date of the authorisation by the Notification Authority or the date of the decision concerning the renewal or amendment of the authorisation by the competent authority in accordance with Regulation (EU) No 528/2012.

2 The protection period shall start when data is submitted for the first time.

3 It cannot be renewed.

4 By way of derogation from paragraph 1, the data protection periods for existing active substances listed in combination with a product type in Annex II to Regulation (EU) No 1062/2014139 – including data not involving tests on vertebrates – but for which a decision on inclusion in Annex I to Directive 98/8/EC140 was not taken before 1 September 2013 shall expire no later than 31 December 2025.141

Art. 28 Durata della protezione dei dati

1 La durata della protezione dei dati trasmessi all’organo di notifica secondo la presente ordinanza è stabilita come segue:

a.
dati trasmessi ai fini dell’approvazione di un principio attivo esistente: 10 anni dopo il primo giorno del mese successivo alla data di approvazione del principio attivo per il tipo di prodotto corrispondente da parte della Commissione europea secondo l’articolo 9 del regolamento (UE) n. 528/2012135;
b.
dati trasmessi ai fini dell’approvazione di un principio attivo nuovo: 15 anni dopo il primo giorno del mese successivo alla data di approvazione del principio attivo per il tipo di prodotto corrispondente da parte della Commissione europea secondo l’articolo 9 del regolamento (UE) n. 528/2012;
c.
dati trasmessi ai fini della proroga o verifica dell’approvazione di un principio attivo nuovo: 5 anni dopo il primo giorno del mese successivo alla data di proroga o verifica dell’approvazione da parte della Commissione europea secondo l’articolo 14 paragrafo 4 del regolamento (UE) n. 528/2012;
d.
dati trasmessi ai fini dell’omologazione di un biocida contenente unicamente principi attivi esistenti: 10 anni dopo il primo giorno del mese successivo all’omologazione da parte dell’organo di notifica o dell’autorità competente secondo il regolamento (UE) n. 528/2012;
e.
dati trasmessi ai fini dell’omologazione di un biocida contenente un principio attivo nuovo: 15 anni dopo il primo giorno del mese successivo all’omologazione da parte dell’organo di notifica o dell’autorità competente secondo il regolamento (UE) n. 528/2012;
f.
dati trasmessi ai fini della proroga o modifica dell’omologazione di un biocida: 5 anni dopo il primo giorno del mese successivo all’omologazione da parte dell’organo di notifica o al momento della decisione sulla proroga o modifica dell’omologazione da parte dell’autorità competente secondo il regolamento (UE) n. 528/2012.

2 La durata della protezione ha inizio al momento della prima trasmissione dei dati.

3 Essa non può essere rinnovata.

4 In deroga al capoverso 1, le durate della protezione dei dati per i principi attivi esistenti ammessi per il tipo di prodotto corrispondente secondo l’allegato II del regolamento (UE) n. 1062/2014136, compresi i dati che non prevedono esperimenti su vertebrati ma per i quali non è stata ancora presa una decisione di iscrizione nell’allegato I della direttiva 98/8 (CE)137 entro il 1° settembre 2013, scadono al più tardi il 31 dicembre 2025.138
