Art. 89 Effects

1 If another State prosecutes the offence, the Swiss authorities may not take further measures against the defendant for the same offence:

a.
unless the requested State has given notice that it is not in a position to conclude the prosecution; or
b.
if, according to the decision made in the requested State, the conditions of Article 5 letter a or b are met.

2 The effect of the time limitation provisions under Swiss law is suspended provided the proceedings including enforcement of the sentence are ongoing in the requested State.143

3 If the defendant was extradited to the requested State for other offences, this State need not observe the conditions of extradition in accordance with Article 38 provided it grants the request for prosecution.

143 The suspension of the effects of the time limitation provisions has been abolished by Art. 97 ff. of the Swiss Criminal Code (SR 311.0) and time limits for execution have been replaced by an extension of the regular time limit (AS 2006 3459; BBl 1999 1979).

Art. 89 Effetti

1 Se uno Stato estero assume il perseguimento penale, le autorità svizzere non possono prendere altri provvedimenti per lo stesso reato contro la persona perseguita:

a.
fintanto che lo Stato richiesto non abbia comunicato di non essere in grado di portare a termine il procedimento, o
b.
se, in base a una decisione presa in questo Stato, sono adempiute le condizioni di cui all’articolo 5 lettera a o b.

2 La prescrizione secondo il diritto svizzero è sospesa per tutta la durata del procedimento nello Stato richiesto, inclusa l’esecuzione penale.141

3 Se la persona perseguita gli è stata estradata per altri fatti, lo Stato richiesto, nella misura in cui dà seguito alla domanda di perseguimento penale, non è tenuto ad osservare le condizioni d’estradizione giusta l’articolo 38.

141 La sospensione della prescrizione è abrogata dagli art. 97 seg. CP (RS 311.0) e sostituita in caso di prescrizione della pena da una prolungazione del termine ordinario (RU 2006 3459; FF 1999 1669).
