Art. 46

1 The Federal Office for Customs and Border Security (FOCBS) is authorised to notify the right holder of a filed design if there is any suspicion that unlawfully manufactured items may imminently be brought into or taken out of Swiss customs territory.27

2 In such cases, the FOCBS28 is authorised to withhold the items for three working days in order that the right holder may file an application under Article 47.

Art. 46

1 L’Ufficio federale della dogana e della sicurezza dei confini (UDSC) è autorizzato ad avvisare il titolare di un design depositato qualora vi sia il sospetto dell’imminente introduzione nel territorio doganale svizzero o dell’imminente asportazione dal territorio doganale svizzero di oggetti prodotti illecitamente.33

2 In tali casi l’UDSC34 è autorizzato a trattenere gli oggetti durante tre giorni feriali affinché il titolare del diritto possa presentare una domanda giusta l’articolo 47.
