1 Membership shall lapse on the death of the member.
2 However, the articles of association may stipulate that the member’s heirs automatically become members of the cooperative.
3 Further, the articles of association may stipulate that the heirs or one of two or more heirs must, on written request, be recognised as member in place of the deceased member.
4 The community of heirs must appoint a joint representative to act as a member of the cooperative.
1 Lo statuto può stabilire i motivi per i quali un socio può essere escluso.
2 Inoltre un socio può sempre essere escluso per motivi gravi.
3 L’esclusione è deliberata dall’assemblea generale. Lo statuto può attribuire siffatta competenza all’amministrazione, nel qual caso il socio escluso ha il diritto di ricorrere all’assemblea generale. Il socio escluso ha la facoltà di contestare l’esclusione davanti al giudice entro il termine di tre mesi.
4 Esso può essere tenuto al pagamento di un’equa indennità alle stesse condizioni che in caso di libero recesso.
