1 An agent is a person who undertakes to act on a continuous basis as an intermediary for one or more principals in facilitating or concluding transactions on their behalf and for their account without entering into an employment relationship with them.258
2 Unless otherwise agreed in writing, the provisions of this Section also apply to persons acting as agents by way of secondary occupation. The provisions governing del credere, prohibition of competition and termination of contracts for good cause may not be excluded to the detriment of the agent.

1 È agente colui che assume stabilmente l’impegno di trattare la conclusione di affari per uno o più mandanti o di conchiuderne in loro nome o per loro conto, senza essere vincolato ad essi da un rapporto di lavoro.258
2 Salvo convenzione contraria stipulata per iscritto, le disposizioni del presente capo si applicano parimente alle persone che esercitano l’attività di agente solo accessoriamente. Le disposizioni relative allo star del credere, al divieto di concorrenza ed allo scioglimento del contratto per cause gravi non possono essere eluse a detrimento dell’agente.
