1 Where the cheque was endorsed only after protest has been made or equivalent action taken or after expiry of the time limit for presentation, the endorsement only has the effects of a normal assignment.
2 Until the opposite is proven, it is presumed that an undated endorsement was made on the cheque before protest was made or equivalent action taken or before the time limit for presentation expired.
Se una persona ha perduto per qualsiasi ragione il possesso di un assegno bancario, il nuovo portatore, cui è pervenuto l’assegno bancario – sia che si tratti di assegno bancario al portatore, sia che si tratti di assegno bancario trasferibile per girata e rispetto al quale il portatore giustifichi il suo diritto nella maniera indicata nell’articolo 1110 – non è tenuto a consegnarlo se non quando l’abbia acquistato in mala fede ovvero abbia commesso colpa grave acquistandolo.
