Art. 1074 a. Duties of the applicant

1 Where the holder of the bill of exchange is known, the court may be asked to cancel it.

2 The party applying for cancellation must satisfy the court that he possessed and lost the bill of exchange and produce either a copy of the bill or information on its essential terms.

Art. 1073 2. Portatore conosciuto

1 Se il portatore della cambiale è conosciuto, il giudice fissa all’istante un congruo termine per proporre l’azione di rivendicazione.

2 Se l’istante non propone l’azione entro questo termine, il giudice toglie il divieto fatto al trattario.
