Art. 72 Successful request for a popular initiative

1 After expiry of the period allowed for the collection of signatures, the Federal Chancellery shall establish whether the popular initiative has obtained the required number of valid signatures. If less than half of the quorum required under the Constitution has been achieved, a notice shall be published in the Federal Gazette stating simply that the period allowed for the collection of signatures has expired. If half or more of the required quorum has been achieved, the Federal Council shall issue a ruling confirming whether or not the popular initiative has been successful.142

2 The following are invalid:

a.
signatures on lists that do not fulfil the requirements of Article 68;
b.
signatures of signatories whose eligibility to vote is not certified;
c.
signatures on lists that have been submitted after the period allowed for the collection of signatures.143

3 The Federal Chancellery shall publish the ruling on the success of the initiative in the Federal Gazette together with details of the numbers of valid and invalid signatures for each canton.

Art. 72 Riuscita

1 Trascorso il termine di raccolta delle firme, la Cancelleria federale accerta se l’iniziativa popolare ha raccolto il numero prescritto di firme valide. Se non è raggiunta almeno la metà del numero costituzionalmente stabilito, viene pubblicata nel Foglio federale una semplice nota indicante che il termine di raccolta delle firme è trascorso infruttuosamente. Nel caso contrario, la Cancelleria federale accerta con una decisione la riuscita o la non riuscita dell’iniziativa popolare.144

2 Sono nulle:

a.
le firme su liste che non adempiono i requisiti di cui all’articolo 68;
b.
le firme di coloro il cui diritto di voto non è stato attestato;
c.
le firme su liste depositate dopo la scadenza del relativo termine di raccolta.145

3 La Cancelleria federale pubblica nel Foglio federale la decisione di riuscita indicando per Cantone il numero delle firme valide e nulle.146
