Art. 49 Analogous application of exemptions for admission to trading

(Art. 38 para. 2 FinSA)

The following exemptions from the duty to publish a prospectus also apply to admission to trading:

a.: Article 37 paragraph 1 letters a–g FinSA, insofar as securities of the same type are already admitted for trading on a Swiss trading venue or Swiss DLT trading facility or a recognised foreign trading venue or DLT trading facility;
b.: Article 37 paragraph 1 letters h and l FinSA.

Art. 49 Application par analogie des exceptions en matière d’admission à la négociation

(art. 38, al. 2, LSFin)

Les exceptions suivantes à l’obligation de publier un prospectus valent aussi pour l’admission à la négociation:

a.: art. 37, al. 1, let. a à g, LSFin, dans la mesure où des valeurs mobilières de la même catégorie sont déjà admises à la négociation sur une plate-forme suisse ou une plate-forme étrangère reconnue;
b.: art. 37, al. 1, let. h et l, LSFin.
