Art. 35 Supervision by FINMA

(Art. 31 para. 1 FinSA)

1 The registration body shall draw up an annual activity report for submission to FINMA. This report shall also contain, in particular, details of coordination with other registration bodies.

2 FINMA must be given prior notice of the following changes:

a.
a change in membership of the management board;
b.
changes to the organisational basis.

3 These changes do not require approval from FINMA.

4 If FINMA grants a licence to several registration bodies, it will ensure appropriate coordination of their practice.

Art. 35 Surveillance par la FINMA

(art. 31, al. 1, LSFin)

1 L’organe d’enregistrement établit un rapport d’activité annuel à l’intention de la FINMA. Ce rapport évoque également la coordination avec d’autres organes d’enregistrement éventuels.

2 La FINMA doit être informée à l’avance des modifications suivantes:

a.
remplacement d’un membre de l’organe responsable de la gestion;
b.
modification des principes organisationnels.

3 Ces modifications ne sont pas soumises à l’approbation de la FINMA.

4 Si elle agrée plusieurs organes d’enregistrement, la FINMA veille à ce que leurs pratiques soient coordonnées de manière appropriée.
