Art. 260sexies Recruiting, training and travelling with a view to committing a terrorist offence

1 Any person who, with a view to committing a violent felony aimed at intimidating the population or coercing a State or an international organisation to act or refrain from acting,

a.
recruits another person to commit or participate in such an offence;
b.
accepts training or trains others in the manufacture or use of weapons, explosives, radioactive materials, poisonous gases or other devices or dangerous substances for the purpose of committing or participating in the commission of such an offence; or
c.
travels abroad with the intention of committing, participating in or training for such an offence
shall be liable to a custodial sentence not exceeding five years or to a monetary penalty.

2 The same penalty shall apply to any person who collects or provides assets with the intention of financing a journey in accordance with paragraph 1 letter c, or any person who organises or recruits others to make such a journey.

3 Any person who carries out any of the foregoing acts outside Switzerland shall also be liable to prosecution if he or she is in Switzerland and is not extradited or if the terrorist offence is to be committed in or against Switzerland. Article 7 paragraphs 4 and 5 apply.

Art. 260sexies Recrutement, formation et voyage en vue d’un acte terroriste

1 Est puni d’une peine privative de liberté de cinq ans au plus ou d’une peine pécuniaire quiconque, en vue d’un acte de violence criminelle visant à intimider une population ou à contraindre un État ou une organisation internationale à accomplir ou à s’abstenir d’accomplir un acte quelconque:

a.
recrute une personne pour qu’elle commette un tel acte ou y participe;
b.
se fait fournir ou fournit des indications pour fabriquer ou utiliser des armes, des explosifs, des matériaux radioactifs, des gaz toxiques ou d’autres dispositifs ou substances dangereuses dans le but de commettre un tel acte ou d’y participer, ou
c.
entreprend un voyage à l’étranger ou depuis l’étranger pour commettre un tel acte, y participer ou suivre une formation dans ce but.

2 Quiconque réunit ou met à disposition des fonds dans le dessein de financer un voyage au sens de l’al. 1, let. c, organise un tel voyage ou recrute une personne en vue d’un tel voyage encourt la même peine.

3 Les actes commis à l’étranger sont également punissables si l’auteur se trouve en Suisse et n’est pas extradé, ou si l’acte terroriste doit être commis en Suisse ou contre la Suisse. L’art. 7, al. 4 et 5, est applicable.
