1. Any person who wilfully damages, destroys, removes, otherwise renders unusable or deactivates a safety device which serves to prevent accidents in a factory or other commercial premises or on a machine,
who wilfully fails to install such a device in violation of the regulations,
and thus knowingly endangers the life and limb of other people,
shall be liable to a custodial sentence not exceeding three years or to a monetary penalty. The custodial sentence must be combined with a monetary penalty.
2. If the person concerned acts through negligence, the penalty is a custodial sentence not exceeding three years or a monetary penalty.
1. Celui qui, intentionnellement, aura endommagé, détruit, supprimé, rendu inutilisable ou mis hors d’usage un appareil destiné à prévenir les accidents dans une fabrique ou une autre exploitation, ou les accidents de machines,
celui qui, contrairement aux prescriptions applicables, aura intentionnellement omis d’installer un tel appareil,
et aura, par là, sciemment mis en danger la vie ou l’intégrité corporelle des personnes,
sera puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire. En cas de peine privative de liberté, une peine pécuniaire est également prononcée.
2. La peine sera une peine privative de liberté de trois ans au plus ou une peine pécuniaire si le délinquant a agi par négligence.
