Art. 185bis Enforced disappearance

1 Any person who with the intention of removing a person from the protection of the law for a prolonged period of time:

a.
on behalf of or with the acquiescence of a State or political organisation, deprives that person of their liberty, and thereafter refuses to give information as to their fate or whereabouts; or
b.
on behalf of or with the acquiescence of a State or political organisation or in violation of a legal duty refuses to give information as to the fate or whereabouts of the person concerned.

shall be liable to a custodial sentence of not less than one year.

2 Any person who commits the offence abroad is also liable to the foregoing penalty provided they are now in Switzerland and are not extradited. Article 7 paragraphs 4 and 5 apply.

Art. 185bis Disparition forcée

1 Est puni d’une peine privative de liberté d’un an au moins quiconque, dans l’intention de soustraire une personne à la protection de la loi pendant une période prolongée:

a.
la prive de liberté sur mandat ou avec l’assentiment d’un État ou d’une organisation politique, toute indication sur le sort qui lui est réservé ou sur l’endroit où elle se trouve étant ensuite refusée, ou
b.
refuse toute indication sur le sort qui lui est réservé ou sur l’endroit où elle se trouve, sur mandat d’un État ou d’une organisation politique ou en enfreignant une obligation légale.

2 Est également punissable quiconque commet l’infraction à l’étranger, s’il se trouve en Suisse et qu’il n’est pas extradé. L’art. 7, al. 4 et 5, est applicable.
