1. A person in addressing a third party, and knowing his allegations to be untrue, makes an accusation against or casts suspicion on another of dishonourable conduct, or of other conduct that shall be liable to damage another's reputation,
any person who disseminates such accusations or suspicions, knowing them to be untrue,
shall be liable on complaint to a custodial sentence not exceeding three years or to a monetary penalty.
2. If the offender has acted systematically to undermine the good reputation of another, he shall be liable to a custodial sentence not exceeding three years or to a monetary penalty of not less than 30 daily penalty units.204
3. If the offender recants his statement before the court on the grounds that it is untrue, the court may impose a more lenient penalty. The court must provide the person harmed with a document confirming the recantation.

1. Celui qui, connaissant la fausseté de ses allégations, aura, en s’adressant à un tiers, accusé une personne ou jeté sur elle le soupçon de tenir une conduite contraire à l’honneur, ou de tout autre fait propre à porter atteinte à sa considération,
celui qui aura propagé de telles accusations ou de tels soupçons, alors qu’il en connaissait l’inanité,
sera, sur plainte, puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.204
2. La peine sera une peine privative de liberté de trois ans au plus ou une peine pécuniaire de 30 jours-amende au moins205 si le calomniateur a, de propos délibéré, cherché à ruiner la réputation de sa victime.
3. Si, devant le juge, le délinquant reconnaît la fausseté de ses allégations et les rétracte, le juge pourra atténuer la peine. Le juge donnera acte de cette rétractation à l’offensé.
