Art. 151 Maliciously causing financial loss to another

Any person who without a view to gain, by making representations or suppressing information, wilfully misleads another or wilfully reinforces an erroneous belief with the result that the person in error acts in such a way that he or another incurs a financial loss shall be liable on complaint to a custodial sentence not exceeding three years or to a monetary penalty.

Art. 151 Atteinte astucieuse aux intérêts pécuniaires d’autrui

Celui qui, sans dessein d’enrichissement, aura astucieusement induit en erreur une personne par des affirmations fallacieuses ou par la dissimulation de faits vrais ou l’aura astucieusement confortée dans son erreur et l’aura ainsi déterminée à des actes préjudiciables à ses intérêts pécuniaires ou à ceux d’un tiers sera, sur plainte, puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.
