950.1 Bundesgesetz vom 15. Juni 2018 über die Finanzdienstleistungen (Finanzdienstleistungsgesetz, FIDLEG)
Art. 89 Violation of the code of conduct
A fine not exceeding CHF 100,000 shall be imposed on any person who wilfully:
- a.
- provides false information or withholds material facts when complying with the duties to provide information under Article 8;
- b.
- seriously violates the duties to assess appropriateness and suitability under Articles 10 to 14;
- c.
- violates the provisions on the disclosure of compensation paid by third parties under Article 26.
Art. 89 Verletzung der Verhaltensregeln
Mit Busse bis zu 100 000 Franken wird bestraft, wer vorsätzlich:
- a.
- bei der Erfüllung der Informationspflichten nach Artikel 8 falsche Angaben macht oder wesentliche Tatsachen verschweigt;
- b.
- die Pflichten zur Angemessenheits- und Eignungsprüfung nach den Artikeln 10–14 in schwerwiegender Weise verletzt;
- c.
- gegen die Bestimmungen über die Herausgabe von Entschädigungen Dritter nach Artikel 26 verstösst.
