1 The cantonal authorities approve projects involving land improvements, agricultural buildings and regional development that receive federal subsidies.140
2 They ask the FOAG for its opinion in good time.
3 They make the project available to the public and publish it in the official cantonal gazette is not required for projects that do not require a concession or planning permission under federal or cantonal legislation.141
4 They give organisations that play a legitimate role in relation to the protection of nature and cultural heritage, the environment or public hiking paths an opportunity to lodge an objection concerning the projects published in the official cantonal gazette.142
5 If necessary, the FOAG consults other federal agencies whose scope of activity also covers the project. It informs the cantonal authorities of the requirements and obligations entailed in the granting of a subsidy for that project.
6 The Federal Council decides which projects should not be passed on to the FOAG for its opinion.
7 The FOAG shall decide whether or not to grant a subsidy only after the project has entered into effect.143

1 Der Kanton genehmigt die Projekte für Bodenverbesserungen, für landwirtschaftliche Gebäude und zur regionalen Entwicklung, die mit Bundesbeiträgen unterstützt werden.140
2 Er holt frühzeitig die Stellungnahme des BLW ein.
3 Er legt das Projekt öffentlich auf und macht es im kantonalen Publikationsorgan bekannt. Keine Publikation erfolgt bei Projekten, für welche nach eidgenössischem oder kantonalem Recht weder eine Konzession noch eine Baubewilligung nötig ist.141
4 Er gibt bei den im kantonalen Publikationsorgan bekannt gegebenen Projekten den Organisationen, die aufgrund der Gesetzgebung über den Natur- und Heimatschutz, den Umweltschutz oder die Wanderwege legitimiert sind, Gelegenheit zur Einsprache.142
5 Das BLW hört nötigenfalls die weiteren Bundesbehörden an, deren Aufgabenbereiche durch das Projekt berührt werden. Es gibt dem Kanton bekannt, unter welchen Voraussetzungen und mit welchen Auflagen ein Projekt mit einem Beitrag unterstützt wird.
6 Der Bundesrat bestimmt, welche Projekte dem BLW nicht zur Stellungnahme zu unterbreiten sind.
7 Über die Gewährung eines Bundesbeitrags entscheidet das BLW erst, wenn das Projekt rechtskräftig ist.143
