Art. 9 Support for self-help measures

1 Insofar as self-help measures mentioned in Article 8 paragraph 1 come under threat from businesses that do not comply with the collectively agreed measures, the Federal Council may introduce regulations if the organisation:22

a.
is representative;
b.
is not active in production, processing or sales;
c.
has approved the self-help measures by a clear majority.

2 The Federal Council may oblige non-members of an organisation to contribute towards funding self-help measures mentioned in Article 8 paragraph 1 if the conditions outlined in paragraph 1 are met and the organisation receives contributions from its members for funding self-help measures. Such contributions may not be used to cover the organisation’s administrative expenses.23

3 With regard to adapting production and supply to market demand, the Federal Council may issue regulations solely in case of exceptional developments that are not caused by structural problems.24

4 Products sold directly to the public may not be made subject to the regulations mentioned in paragraph 1, and farmers who sell direct to the public may not be made liable for contributions under paragraph 2 based on the volume of products thus sold.

Art. 9 Unterstützung von Selbsthilfemassnahmen

1 Sofern die Selbsthilfemassnahmen nach Artikel 8 Absatz 1 durch Unternehmen gefährdet werden, die sich nicht an den kollektiv beschlossenen Massnahmen beteiligen, kann der Bundesrat Vorschriften erlassen, wenn die Organisation:22

a.
repräsentativ ist;
b.
weder in der Produktion noch in der Verarbeitung noch im Verkauf tätig ist;
c.
die Selbsthilfemassnahmen mit grossem Mehr beschlossen hat.

2 Der Bundesrat kann Nichtmitglieder einer Organisation verpflichten, Beiträge zur Finanzierung von Selbsthilfemassnahmen nach Artikel 8 Absatz 1 zu leisten, wenn die Bedingungen nach Absatz 1 erfüllt sind und die Organisation von ihren Mitgliedern Beiträge für die Finanzierung von Selbsthilfemassnahmen erhebt. Mit den Beiträgen darf nicht die Verwaltung der Organisation finanziert werden.23

3 Im Bereich der Anpassung der Produktion und des Angebotes an die Erfordernisse des Marktes kann der Bundesrat ausschliesslich Vorschriften erlassen für den Fall ausserordentlicher Entwicklungen, die nicht durch strukturelle Probleme bedingt sind.24

4 Produkte aus der Direktvermarktung dürfen nicht den Vorschriften nach Absatz 1 unterstellt werden, und Direktvermarkterinnen und Direktvermarkter dürfen für die direkt vermarkteten Mengen nicht der Beitragspflicht nach Absatz 2 unterstellt werden.
