1 Branch organisations in the milk sector are responsible for drawing up a standard contract for the purchase and sale of untreated milk. The provisions of the standard contract may not have a marked detrimental effect on competition. The contracting partners are responsible for setting prices and quantities.
2 A standard contract within the meaning of this Article is a contract that has a minimum period of validity and possible extension of one year and includes terms concerning quantities, prices and methods of payment.
3 At the request of a branch organisation, the Federal Council may declare the standard contract to be generally binding in relation to all stages of the purchase and sale of untreated milk.
4 The requirements that must be met by the branch organisations and the decision making are governed by Article 9 paragraph 1.
5 Any litigation arising from the standard contract or individual contracts is subject to the jurisdiction of the civil courts.
6 If a branch organisation is unable to agree on a standard contract, the Federal Council may issue temporary regulations on the purchase and sale of untreated milk.
1 Die Ausarbeitung eines Standardvertrags für den Kauf und den Verkauf von Rohmilch ist Sache der Branchenorganisationen des Milchsektors. Die Regelungen im Standardvertrag dürfen den Wettbewerb nicht erheblich beeinträchtigen. Die Preis- und Mengenfestlegung bleibt in jedem Fall in der Kompetenz der Vertragspartner.
2 Ein Standardvertrag im Sinne dieses Artikels ist ein Vertrag, der eine minimale Vertrags- und Vertragsverlängerungsdauer von einem Jahr sowie mindestens Regelungen über die Mengen, die Preise und die Zahlungsmodalitäten enthält.
3 Der Bundesrat kann den Standardvertrag auf Begehren einer Branchenorganisation auf allen Stufen des Kaufes und des Verkaufes von Rohmilch allgemeinverbindlich erklären.
4 Die Anforderungen an die Branchenorganisation und die Beschlussfassung richten sich nach Artikel 9 Absatz 1.
5 Für Streitigkeiten aus dem Standardvertrag und den einzelnen Verträgen sind die Zivilgerichte zuständig.
6 Kann sich eine Branchenorganisation nicht auf einen Standardvertrag einigen, so kann der Bundesrat vorübergehend Vorschriften über den Kauf und den Verkauf von Rohmilch erlassen.
