1 The cantonal authorities are responsible for prosecutions.
2 Any person who breaches the regulations on importing, exporting or transiting goods shall be prosecuted and be liable to the penalties under the legislation on customs tariffs. The authorities may not proceed with a prosecution in particularly minor cases of violation concerning the use of import quotas for agricultural products.248
3 If an act simultaneously constitutes an offence under paragraph 2 and an offence prosecuted by the Federal Office for Customs and Border Security, the penalty for the more serious offence applies; the penalty may be raised accordingly.249

2 Wer die Vorschriften über die Ein-, Aus- oder Durchfuhr verletzt, wird nach der Zollgesetzgebung verfolgt und bestraft. In besonders leichten Fällen der Widerhandlung im Bereich der Bewirtschaftung der Einfuhrkontingente für landwirtschaftliche Erzeugnisse kann von einem Strafverfahren abgesehen werden.248
3 Erfüllt eine Handlung gleichzeitig den Tatbestand einer Widerhandlung nach Absatz 2 und einer anderen vom Bundesamt für Zoll und Grenzsicherheit zu verfolgenden Widerhandlung, so wird die Strafe für die schwerere Widerhandlung verhängt; diese kann angemessen erhöht werden.249
