Art. 172 Misdemeanours and felonies

1 Any person who unlawfully uses a designation of origin or a geographical indication protected under Article 16 or a classification or label under Article 63 shall on complaint be liable to a custodial sentence not exceeding one year or to a monetary penalty. In relation to classification and labelling under Article 63, monitoring agencies mandated by the Federal Council under Article 64 paragraph 4 and used by the cantons also have the right to file a complaint.

2 Any person suspected of committing an offence for commercial gain shall be prosecuted ex officio, and shall be liable to a custodial sentence not exceeding five years or a monetary penalty. A custodial sentence must be combined with a monetary penalty.231

Art. 172 Vergehen und Verbrechen

1 Wer eine geschützte Ursprungsbezeichnung oder eine geschützte geografische Angabe nach Artikel 16 oder eine Klassierung oder Kennzeichnung nach Artikel 63 widerrechtlich verwendet, wird auf Antrag mit Freiheitsstrafe bis zu einem Jahr oder Geldstrafe bestraft. Bezüglich der Klassierung und Kennzeichnung nach Artikel 63 steht das Antragsrecht auch dem vom Bundesrat nach Artikel 64 Absatz 4 beauftragten sowie den durch die Kantone eingesetzten Kontrollorganen zu.

2 Wer gewerbsmässig handelt, wird von Amtes wegen verfolgt. Die Strafe ist Freiheitsstrafe bis zu fünf Jahren oder Geldstrafe. Mit der Freiheitsstrafe ist eine Geldstrafe zu verbinden.231
