910.1 Bundesgesetz vom 29. April 1998 über die Landwirtschaft (Landwirtschaftsgesetz, LwG)
Art. 152 Import, export, production and circulation
1 The Federal Council shall draw up regulations on the import and circulation of:
- a.
- particularly dangerous harmful organisms;
- b.
- plant material and goods that may carry particularly dangerous harmful organisms.
2 In particular it may:
- a.
- stipulate that a permit is required for bringing certain plant material into circulation;
- b.
- issue regulations concerning the registration and monitoring of businesses that produce or circulate such plant material;
- c.
- oblige such businesses to keep records concerning the plant material in question;
- d.
- forbid the import and circulation of plant material that carries or may carry particularly dangerous harmful organisms;
- e.
- forbid the cultivation of highly susceptible host plants.
3 The Federal Council shall ensure that plant material intended for export meets international requirements.
Art. 152 Einfuhr, Ausfuhr, Produktion und Inverkehrbringen
1 Der Bundesrat erlässt Vorschriften über die Einfuhr und das Inverkehrbringen von:
- a.
- besonders gefährlichen Schadorganismen;
- b.
- Pflanzenmaterial und Gegenständen, die Träger von besonders gefährlichen Schadorganismen sein können.
2 Er kann insbesondere:
- a.
- festlegen, dass bestimmtes Pflanzenmaterial nur mit einer Bewilligung in Verkehr gebracht werden darf;
- b.
- Vorschriften erlassen über die Registrierung und die Kontrolle von Betrieben, die solches Pflanzenmaterial produzieren oder in Verkehr bringen;
- c.
- diese Betriebe verpflichten, über solches Pflanzenmaterial Buch zu führen;
- d.
- die Einfuhr und das Inverkehrbringen von Pflanzenmaterial, das von besonders gefährlichen Schadorganismen befallen ist oder befallen sein könnte, untersagen;
- e.
- den Anbau stark anfälliger Wirtspflanzen untersagen.
3 Der Bundesrat sorgt dafür, dass das zur Ausfuhr bestimmte Pflanzenmaterial die internationalen Anforderungen erfüllt.
