Art. 23b Exception for FFP masks

1 FFP masks that do not comply with the principles and procedures for conformity assessment under Article 3 paragraph 2 of the PPE Ordinance of 25 October 201755 (PPEO) and whose non-compliance with these principles and procedure has not been approved based on Article 24 paragraph 3 in its version of 22 June 202056 may not be placed on the market.

2 FFP masks under paragraph 1 held in federal and cantonal stocks may be supplied to private hospitals, homes for the elderly and care homes and organisations that provide nursing services and other assistance at home as well as to federal and cantonal facilities such as the armed forces, civil defence units, hospitals and prisons provided the federal or cantonal authority responsible for the supply:

a.
guarantees by means of testing by a recognised European conformity assessment body for FFP masks that the masks provide a level of safety equivalent to that legally required under the PPEO; and
b.
guarantees their traceability.

3 Product information in at least one official language or in English must be available when the masks are supplied. It must be ensured that the user is able to use the product in accordance with the relevant provisions.

Art. 23b Ausnahme für Atemschutzmasken

1 Atemschutzmasken, die nicht den Grundsätzen und Verfahren für die Konformitätsbewertung nach Artikel 3 Absatz 2 der PSA-Verordnung vom 25. Oktober 201755 (PSAV) entsprechen und deren Abweichung von diesen Grundsätzen und Verfahren nicht gestützt auf Artikel 24 Absatz 3 in der Fassung vom 22. Juni 202056 genehmigt wurde, dürfen nicht auf dem Markt bereitgestellt werden.

2 Atemschutzmasken nach Absatz 1, die sich in Lagerbeständen von Bund und Kantonen befinden, können an private Spitäler, Alters- und Pflegeheime und Organisationen der Krankenpflege und Hilfe zu Hause sowie an Einrichtungen von Bund und Kantonen wie Armee, Zivilschutz, Spitäler und Gefängnisse abgegeben werden, wenn die beim Bund oder beim Kanton für die Abgabe verantwortliche Stelle:

a.
mittels Prüfung durch eine europäische anerkannte Konformitätsbewertungsstelle für Atemschutzmasken ein im Hinblick auf die geltenden rechtlichen Anforderungen nach der PSAV gleichwertiges Sicherheitsniveau gewährleistet; und
b.
die Rückverfolgbarkeit gewährleistet.

3 Die Produktinformation muss bei der Abgabe verfügbar und mindestens in einer Amtssprache oder in Englisch abgefasst sein. Es muss sichergestellt sein, dass die Anwenderin oder der Anwender die notwendigen Voraussetzungen mitbringt, um das Produkt bestimmungsgemäss zu verwenden.
