Art. 62 Information system of the Federal Food Safety and Veterinary Office

¹ The Federal Food Safety and Veterinary Office (FSVO) shall operate an information system:

a.: to guarantee the safety and hygiene of foodstuffs and utility articles as well as protection against deception in terms of its duties under this Act;
b.: to support the enforcement activities of the Confederation and cantons under this Act;
c.: to facilitate reporting at national and international levels.

² The FSVO information system is part of the joint central information system along the food chain of the Federal Office for Agriculture (FOAG) and of the FSVO that aims to guarantee the safety of foodstuffs and utility articles, fodder safety, animal welfare, animal protection and faultless primary production.

³ The FSVO information system shall contain personal data including:

a.: data on administrative and criminal proceedings and sanctions;
b.: health data in relation to the safety of foodstuffs and utility articles;
c.: data on the results of inspections and laboratory analyses;
d.: data on deception in connection with foodstuffs and utility articles.

⁴ In terms of their statutory duties, the following authorities may process data in the FSVO information system online:

a.: the FSVO: to guarantee the safety of foodstuffs and utility articles, the hygiene of foodstuffs and utility articles, protection against deception, fodder safety, animal welfare, animal protection and faultless primary production;
b.: the FOAG: to guarantee the safety of foodstuffs and utility articles, the hygiene of foodstuffs and utility articles, protection against deception, fodder safety, animal welfare, animal protection and faultless primary production;
c.¹⁶: the Federal Office for Customs and Border Security (FOCBS): for the purpose of carrying out its duties under Article 38 paragraph 1;
d.: the cantonal enforcement authorities: to fulfil their duties in their respective areas of responsibility.

⁵ In order to fulfil their duties, the following authorities may access the following data in the FSVO information system online:

a.: the FSVO: data on the safety of foodstuffs and utility articles, the hygiene of foodstuffs and utility articles, protection against deception, fodder safety, animal welfare, animal protection and primary production;
b.: the FOAG: data on the safety of foodstuffs and utility articles, the hygiene of foodstuffs and utility articles, protection against deception, fodder safety, animal welfare, animal protection and primary production;
c.¹⁷: the FOCBS: data for the purpose of carrying out its duties under Article 38 paragraph 1;
d.: other federal agencies responsible for implementing this Act: data that they require to fulfil the duties assigned to them, provided the Federal Council so provides;
e.: the cantonal enforcement authorities: data on the safety of foodstuffs and utility articles, the hygiene of foodstuffs and utility articles, protection against deception, fodder safety, animal welfare, animal protection and primary production;
f.: third parties assigned public duties under Article 55: data that they require to fulfil the duties assigned to them;
g.: third parties entrusted with public duties under Articles 14–16, 18, 64 and 180 of the Agriculture Act of 29 April 1998¹⁸: data that they require to fulfil the duties assigned to them.

⁶ The Federal Council shall regulate the following in relation to the FSVO information system:

a.: the structure and the data catalogue, including the part used by the cantons;
b.: responsibility for data processing;
c.: rights of access, and in particular rights of online access;
d.: the organisational and technical measures required to ensure data protection and data security;
e.: the procedure for working with the cantons;
f.: the periods for which data must be retained and after which data must be destroyed;
g.: archiving.

⁷ Cantons that use the FSVO information system for their own enforcement duties use must issue equivalent data protection provisions for their field of activity and designate an authority to oversee compliance.

Art. 62 Informationssystem des Bundesamtes für Lebensmittelsicherheit und Veterinärwesen

¹ Das Bundesamt für Lebensmittelsicherheit und Veterinärwesen (BLV) betreibt ein Informationssystem:

a.: zur Gewährleistung der Sicherheit und der Hygiene von Lebensmitteln und Gebrauchsgegenständen sowie des Täuschungsschutzes im Rahmen seiner Aufgaben nach diesem Gesetz;
b.: zur Unterstützung der Vollzugsaufgaben von Bund und Kantonen nach diesem Gesetz;
c.: zur nationalen und internationalen Berichterstattung.

² Das Informationssystem des BLV ist Teil des gemeinsamen zentralen Informa-tionssystems entlang der Lebensmittelkette des Bundesamtes für Landwirtschaft (BLW) und des BLV zur Gewährleistung der Sicherheit von Lebensmitteln und Gebrauchsgegenständen, der Futtermittelsicherheit, der Tiergesundheit, des Tierschutzes sowie einer einwandfreien Primärproduktion.

³ Das Informationssystem des BLV enthält Personendaten einschliesslich:

a.: Daten über administrative und strafrechtliche Verfolgungen und Sanktionen;
b.: Gesundheitsdaten im Bereich der Sicherheit von Lebensmitteln und Gebrauchsgegenständen;
c.: Daten über Ergebnisse von Kontrollen und Laboranalysen;
d.: Daten über Täuschungen im Zusammenhang mit Lebensmitteln und Gebrauchsgegenständen.

⁴ Im Rahmen ihrer gesetzlichen Aufgaben können die folgenden Behörden Daten im Informationssystem des BLV online bearbeiten:

a.: das BLV: zur Gewährleistung der Sicherheit von Lebensmitteln und Gebrauchsgegenständen, der Hygiene von Lebensmitteln und Gebrauchsgegenständen, des Täuschungsschutzes, der Futtermittelsicherheit, der Tiergesundheit, des Tierschutzes und einer einwandfreien Primärproduktion;
b.: das BLW: zur Gewährleistung der Sicherheit von Lebensmitteln, der Hygiene von Lebensmitteln, des Täuschungsschutzes, der Futtermittelsicherheit, der Tiergesundheit und des Tierschutzes und einer einwandfreien Primärproduktion;
c.¹⁶: das Bundesamt für Zoll und Grenzsicherheit (BAZG): zum Zweck des Aufgabenvollzugs nach Artikel 38 Absatz 1;
d.: die kantonalen Vollzugsbehörden zur Erfüllung ihrer Aufgaben in ihrem jeweiligen Zuständigkeitsbereich.

⁵ Zur Erfüllung ihrer Aufgaben können die folgenden Stellen die nachstehenden Daten im Informationssystem des BLV online abrufen:

a.: das BLV: Daten über die Sicherheit von Lebensmitteln und Gebrauchsgegenständen, die Hygiene von Lebensmitteln und Gebrauchsgegenständen, den Täuschungsschutz, die Futtermittelsicherheit, die Tiergesundheit, den Tierschutz und die Primärproduktion;
b.: das BLW: Daten über die Sicherheit von Lebensmitteln, die Hygiene von Lebensmitteln, den Täuschungsschutz, die Futtermittelsicherheit, die Tiergesundheit, den Tierschutz und die Primärproduktion;
c.¹⁷: das BAZG: Daten zum Zweck des Aufgabenvollzugs nach Artikel 38 Absatz 1;
d.: weitere Bundesstellen, die mit Aufgaben zur Umsetzung dieses Gesetzes beauftragt sind: Daten, welche zur Erfüllung der ihnen übertragenen Aufgaben erforderlich sind, sofern der Bundesrat dies vorsieht;
e.: die kantonalen Vollzugsbehörden: Daten über die Sicherheit von Lebensmitteln und Gebrauchsgegenständen, die Hygiene von Lebensmitteln und Gebrauchsgegenständen, den Täuschungsschutz, die Futtermittelsicherheit, die Tiergesundheit, den Tierschutz und die Primärproduktion;
f.: Dritte, denen nach Artikel 55 öffentliche Aufgaben übertragen sind: Daten, welche zur Erfüllung der ihnen übertragenen Aufgaben erforderlich sind;
g.: Dritte, die mit Aufgaben nach den Artikeln 14–16, 18, 64 und 180 des Landwirtschaftsgesetzes vom 29. April 1998¹⁸ betraut sind: Daten, welche zur Erfüllung der ihnen übertragenen Aufgaben erforderlich sind.

⁶ Der Bundesrat regelt für das Informationssystem des BLV:

a.: die Struktur und den Datenkatalog, einschliesslich des von den Kantonen genutzten Teils;
b.: die Verantwortlichkeiten für die Datenbearbeitung;
c.: die Zugriffsrechte, namentlich den Umfang der Online-Zugriffsrechte;
d.: die zur Sicherstellung des Datenschutzes und der Datensicherheit erforderlichen organisatorischen und technischen Massnahmen;
e.: das Verfahren der Zusammenarbeit mit den Kantonen;
f.: die Aufbewahrungs- und Vernichtungsfrist;
g.: die Archivierung.

⁷ Die Kantone, die das Informationssystem des BLV für ihre eigenen Vollzugsaufgaben nutzen, sind verpflichtet, für ihren Bereich gleichwertige Datenschutzbestimmungen aufzustellen und ein Organ zu bezeichnen, welches deren Einhaltung überwacht.
