Art. 35

¹ Any person who wilfully:

a.: handles genetically modified organisms in such a way that the principles of Articles 6–9 are violated;
b.: in handling genetically modified or pathogenic organisms fails to take all necessary containment measures or carries out activities in contained systems without notification or authorisation (Art. 10);
c.: releases genetically modified organisms for experimental purposes or puts them into circulation without permission (Art. 11 para. 1 and 12 para. 1);
d.²¹: puts genetically modified organisms into circulation without informing and instructing the recipient appropriately (Art. 15 para. 1);
e.: handles genetically modified organisms contrary to instructions (Art. 15 para. 2);
f.: violates provisions on product flow segregation and on the precautions to prevent contamination (Art. 16);
g.²²: puts genetically modified organisms into circulation without labelling them as such for the recipient (Art. 17 para. 1);
h.: violates the provisions on the labelling of products obtained from genetically modified organisms (Art. 17 para. 4);
i.: puts genetically modified organisms into circulation and labels them as «not genetically modified» (Art. 17 para. 5);
j.: violates special provisions on the handling of genetically modified organisms (Art. 19);
is liable to a custodial sentence not exceeding three years or to a monetary penalty.²³

Art. 35

¹ Mit Freiheitsstrafe bis zu drei Jahren oder Geldstrafe wird bestraft, wer vorsätzlich:²¹

a.: mit gentechnisch veränderten Organismen so umgeht, dass die Grundsätze von Artikel 6–9 verletzt werden;
b.: beim Umgang mit gentechnisch veränderten Organismen nicht alle notwendigen Einschliessungsmassnahmen trifft oder in geschlossenen Systemen ohne Meldung oder Bewilligung tätig ist (Art. 10);
c.: gentechnisch veränderte Organismen ohne Bewilligung im Versuch freisetzt oder in Verkehr bringt (Art. 11 Abs. 1 und 12 Abs. 1);
d.²²: gentechnisch veränderte Organismen in Verkehr bringt, ohne die Abnehmerin oder den Abnehmer entsprechend zu informieren und anzuweisen (Art. 15 Abs. 1);
e.: mit gentechnisch veränderten Organismen entgegen den Anweisungen umgeht (Art. 15 Abs. 2);
f.: Bestimmungen über die Trennung des Warenflusses und über Vorkehrungen zur Vermeidung von Verunreinigungen verletzt (Art. 16);
g.²³: gentechnisch veränderte Organismen in Verkehr bringt, ohne sie für die Abnehmerin oder den Abnehmer als solche zu kennzeichnen (Art. 17 Abs. 1);
h.: die Vorschriften über die Kennzeichnung von Erzeugnissen, die aus gentechnisch veränderten Organismen gewonnen wurden, verletzt (Art. 17 Abs. 4);
i.: gentechnisch veränderte Organismen in Verkehr bringt und sie als «nicht gentechnisch verändert» kennzeichnet (Art. 17 Abs. 5);
j.: besondere Vorschriften über den Umgang mit gentechnisch veränderten Organismen (Art. 19) verletzt.

³ Handelt die Täterin oder der Täter fahrlässig, so ist die Strafe Geldstrafe bis zu 180 Tagessätzen.²⁵
