Art. 9 Confidentiality

1 Information in accordance with Article 5 paragraph 1 is deemed to be public if its disclosure is not contrary to any overriding private or public interests that are worthy of protection.

2 Private or public interests that are worthy of protection are the interests listed in Article 7 of the Freedom of Information Act of 17 December 20043.

3 Anyone who submits documents to the FOEN must:

a.
indicate any information that should be treated as confidential; and
b.
provide reasons why the interest claimed takes precedence over the interest in publication.

4 The FOEN shall assess whether the interest claimed should take precedence. If its assessment is not consistent with the application made by the facility owner or operator, it must inform the facility owner or operator of this by means of a formal decision after giving the owner or operator the opportunity to state his position.

5 If information is treated as confidential, notice must be given in the Register of the type of information and the reason for its confidentiality.

Art. 9 Vertraulichkeit

1 Informationen nach Artikel 5 Absatz 1 sind öffentlich, wenn der Bekanntgabe keine überwiegenden schutzwürdigen privaten oder öffentlichen Interessen entgegenstehen.

2 Als schutzwürdige private oder öffentliche Interessen gelten die in Artikel 7 des Öffentlichkeitsgesetzes vom 17. Dezember 20043 aufgeführten Interessen.

3 Wer dem BAFU Unterlagen einreicht, muss:

a.
die Angaben bezeichnen, die vertraulich behandelt werden sollen; und
b.
begründen, warum das geltend gemachte Interesse das Interesse an der Veröffentlichung überwiegt.

4 Das BAFU beurteilt, ob das geltend gemachte Interesse überwiegt. Weicht seine Beurteilung vom Antrag der Betriebsinhaberin ab, so teilt es dies der Betriebsinhaberin nach vorgängiger Anhörung durch Verfügung mit.

5 Werden Informationen vertraulich behandelt, sind im Register der Typ der Information und der Grund für die Vertraulichkeit festzuhalten.
