1 Any person has the right to inspect environmental information in official documents and information relating to energy regulations that relate the environment and to request information from the authorities about the content of these documents.
2 In the case of federal authorities, this right is governed by the Freedom of Information Act of 17 December 200427 (FoIA). Article 23 FoIA applies only to documents that contain information under paragraph 1 relating to nuclear installations.
3 The right to inspect also applies in the case of public corporations and private individuals who have been entrusted with enforcement duties but which do not have the power to issue rulings in accordance with Article 5 of the Administrative Procedure Act of 20 December 196828. In these cases, the competent enforcement authority shall issue rulings under Article 15 FoIA.
4 In the case of cantonal authorities, the right is governed by cantonal law. If the cantons have not issued provisions on the access to documents, they shall apply the provisions of this Act and the FoIA mutatis mutandis.
1 Jede Person hat das Recht, in amtlichen Dokumenten enthaltene Umweltinformationen sowie Informationen im Bereich der Energievorschriften, die sich auch auf die Umwelt beziehen, einzusehen und von den Behörden Auskünfte über den Inhalt dieser Dokumente zu erhalten.
2 Bei Behörden des Bundes richtet sich der Anspruch nach dem Öffentlichkeitsgesetz vom 17. Dezember 200427 (BGÖ). Artikel 23 BGÖ findet nur Anwendung auf Dokumente, die Informationen nach Absatz 1 im Bereich von Kernanlagen enthalten.
3 Das Einsichtsrecht gilt auch bei öffentlich-rechtlichen Körperschaften und Privaten, die mit Vollzugsaufgaben betraut wurden, ohne dass ihnen Verfügungskompetenz im Sinne von Artikel 5 des Verwaltungsverfahrensgesetzes vom 20. Dezember 196828 zukommt. In diesen Fällen erlässt die zuständige Vollzugsbehörde Verfügungen nach Artikel 15 BGÖ.
4 Bei Behörden der Kantone richtet sich der Anspruch nach dem kantonalen Recht. Soweit die Kantone noch keine Bestimmungen über den Zugang zu Dokumenten erlassen haben, wenden sie die Bestimmungen dieses Gesetzes und des BGÖ sinngemäss an.
