813.1 Bundesgesetz vom 15. Dezember 2000 über den Schutz vor gefährlichen Stoffen und Zubereitungen (Chemikaliengesetz, ChemG)
Art. 34 Enforcement powers of federal government
1 The federal government shall enforce:
- a.
- Article 5 paragraph 1 letter a (assessment and classification of substances and preparations) and the requirements based on Article 5 paragraph 2 letter a;
- b.
- Article 7 (manufacturer’s obligation to inform purchasers);
- c.
- Articles 9–17 (notification of and authorisation for specific substances and preparations);
- d.
- Article 18 (reporting of details of substances and preparations);
- e.
- Article 19 paragraph 2 letter d (exports);
- f.
- Articles 26–30 (documentation and information), with the exception of Article 28 paragraph 3.
2 It may delegate responsibility to the cantons for individual parts of the tasks specified in paragraph 1 or request their participation in specific parts of tasks.
3 The federal government is responsible for enforcement with regard to the following matters:
- a.
- installations, activities, substances and preparations required for the purposes of national defence;
- b.
- imports, through transit or exports.
Art. 34 Vollzugskompetenzen des Bundes
1 Der Bund vollzieht:
- a.
- Artikel 5 Absatz 1 Buchstabe a (Beurteilung und Einstufung von Stoffen und Zubereitungen) und die auf Artikel 5 Absatz 2 Buchstabe a gestützten Bestimmungen;
- b.
- Artikel 7 (Informationspflicht der Herstellerin);
- c.
- die Artikel 9–17 (Anmeldung und Zulassung von bestimmten Stoffen und Zubereitungen);
- d.
- Artikel 18 (Meldungen über Stoffe und Zubereitungen);
- e.
- Artikel 19 Absatz 2 Buchstabe d (Ausfuhr);
- f.
- Artikel 26–30 (Dokumentation und Information), mit Ausnahme von Artikel 28 Absatz 3.
2 Er kann einzelne Teilaufgaben nach Absatz 1 den Kantonen übertragen oder sie für bestimmte Teilaufgaben beiziehen.
3 Dem Bund obliegt der Vollzug, soweit es sich handelt um:
- a.
- Anlagen, Tätigkeiten, Stoffe und Zubereitungen, die der Landesverteidigung dienen;
- b.
- Einfuhr, Durchfuhr oder Ausfuhr.
