1 OFCOM shall ensure that this Act and its implementing provisions, the licence and relevant international agreements are complied with. The Complaints Authority is responsible for dealing with complaints about the content of editorial publications and refusal of access to the programme service or other journalistic services from SRG SSR (Art. 83 para. 1 let. a and Art. 94–98).86
2 Supervisory measures relating to the production and preparation of programme services and the other journalistic services from SRG SSR and on the grounds of simple expediency are not permitted.87
3 The provisions of the APA88 apply to the supervisory procedure unless this Act provides otherwise.
4 No provisional measures are permitted in the Complaints Authority’s supervision procedure (Art. 91–98).89
5 The Complaints Authority only evaluates complaints against published editorial publications and complaints about refusal of access to the programme service or to other journalistic services from SRG SSR. It does not act ex officio.90

1 Das BAKOM wacht darüber, dass dieses Gesetz und die Ausführungsbestimmungen, die Konzession sowie die einschlägigen internationalen Übereinkommen eingehalten werden. Für die Behandlung von Beschwerden über den Inhalt redaktioneller Publikationen sowie den verweigerten Zugang zum Programm oder zum übrigen publizistischen Angebot der SRG (Art. 83 Abs. 1 Bst. a und Art. 94–98) ist die Beschwerdeinstanz zuständig.86
2 Aufsichtsmassnahmen, die sich auf Produktion und Vorbereitung der Programme und des übrigen publizistischen Angebots der SRG beziehen, sowie reine Zweckmässigkeitskontrollen sind nicht zulässig.87
3 Auf das Aufsichtsverfahren sind die Bestimmungen des VwVG88 anwendbar, sofern das vorliegende Gesetz nicht davon abweicht.
4 Im Verfahren der Aufsicht durch die Beschwerdeinstanz (Art. 91–98) sind keine vorsorglichen Massnahmen zulässig.89
5 Die Beschwerdeinstanz beurteilt einzig Beschwerden gegen veröffentlichte redaktionelle Publikationen und Beschwerden wegen der Verweigerung des Zugangs zum Programm oder zum übrigen publizistischen Angebot der SRG. Sie wird nicht von Amtes wegen tätig.90
