1 After the licensing procedure has been concluded, a conciliation and assessment procedure shall be carried out before the Compulsory Purchase Tribunal (insofar as this may be necessary), in accordance with the provisions of the CPA26.27

3 The Chairman of the Compulsory Purchase Tribunal may approve premature occupancy on the basis of an enforceable licence ruling. For this purpose it shall be assumed that the expropriator would suffer significant disadvantages if premature occupancy were to be denied. Otherwise the provisions of Article 76 of the CPA apply.

1 Nach Abschluss des Bewilligungsverfahrens wird, soweit erforderlich, das Einigungs- und Schätzungsverfahren vor der Eidgenössischen Schätzungskommission (Schätzungskommission) nach den Bestimmungen des EntG26 durchgeführt.27

3 Der Präsident der Schätzungskommission kann gestützt auf einen vollstreckbaren Bewilligungsentscheid die vorzeitige Besitzeinweisung bewilligen. Dabei wird vermutet, dass dem Enteigner ohne die vorzeitige Besitzeinweisung bedeutende Nachteile entstünden. Im Übrigen gilt Artikel 76 EntG.
