Art. 19 Large-scale damage

1 In the event of the occurrence of large-scale damage, the Federal Assembly may issue a compensation plan in the form of an ordinance.

2 There is large-scale damage if, as the result of a disaster, it has to be anticipated that:

a.
the funds available to the persons who are liable and are required to cover liability risks to cover the damage are insufficient to meet all claims for compensation; or
b.
it is not possible to carry out ordinary compensation proceedings due to the large number of claimants.

3 In its compensation plan, the Federal Assembly shall define the principles for the just distribution of all available funds for settling claims.

4 In its compensation plan, the Federal Assembly may:

c.
deviate from the provisions of this Act or from other provisions governing compensation claims;
d.
provide that the Federal Government will pay additional contributions to compensate uncovered damage and that payment thereof shall be made dependent on payments effected by the canton in which the water retaining facility is located;
e.
regulate the procedures for the enforcement of its compensation plan and appoint an independent panel against whose rulings an appeal may be filed with the Federal Supreme Court.

5 The Federal Council shall take precautionary measures.

Art. 19 Grossschaden

1 Im Falle eines Grossschadens kann die Bundesversammlung durch Verordnung eine Entschädigungsordnung aufstellen.

2 Ein Grossschaden liegt vor, wenn bei einem Schadenereignis damit zu rechnen ist, dass:

a.
die für die Deckung der Schäden zur Verfügung stehenden Mittel der haftpflichtigen und der deckungspflichtigen Personen zur Befriedigung aller Ansprüche nicht ausreichen; oder
b.
wegen der grossen Zahl von Geschädigten das ordentliche Verfahren nicht durchgeführt werden kann.

3 Die Bundesversammlung legt in der Entschädigungsordnung die Grundsätze zur gerechten Verteilung aller verfügbaren Mittel zur Befriedigung der Geschädigten fest.

4 Sie kann in der Entschädigungsordnung:

a.
von den Bestimmungen dieses Gesetzes oder von andern schadenersatzrechtlichen Bestimmungen abweichen;
b.
vorsehen, dass der Bund zusätzliche Beiträge an den nicht gedeckten Schaden leistet und deren Zahlung von Leistungen des Kantons abhängig macht, in dem die Stauanlage liegt;
c.
das Verfahren zum Vollzug dieser Ordnung regeln und eine unabhängige Instanz einsetzen, deren Entscheide ans Bundesgericht weitergezogen werden können.

5 Der Bundesrat trifft vorsorgliche Massnahmen.
