Art. 61 Transactions

1 Emission allowances, emission-reduction certificates and attestations are freely tradable.

2 The authorised representatives for the account, authorised auction agents and the transaction validators and bid validators have the right to secure access to the Emissions Trading Registry.

3 When ordering a transaction involving emission allowances, emission-reduction certificates or attestations, authorised representatives for the account must give details of:

a.
the source and destination accounts; and
b.
type and quantity of emission allowances, emission-reduction certificates or attestations to be transferred.

4 The emission allowances, emission-reduction certificates or attestations are transferred when the transaction validator consents to the transfer.

5 The transaction is carried out according to a standardised procedure.

Art. 60 Eintragung ins Emissionshandelsregister

1 Sämtliche Emissionsrechte, Emissionsminderungszertifikate, Bescheinigungen und Versteigerungsgebote müssen im Emissionshandelsregister eingetragen sein.

2 Veränderungen im Bestand der Emissionsrechte, Emissionsminderungszertifikate und Bescheinigungen sind nur gültig, wenn sie im Emissionshandelsregister eingetragen sind.

3 Emissionsminderungszertifikate für die folgenden Emissionsverminderungen können nicht in das Emissionshandelsregister eingetragen werden:

a.
langfristig zertifizierte Emissionsreduktionen (lCER);
b.
temporär zertifizierte Emissionsreduktionen (tCER);
c.
zertifizierte Emissionsreduktionen aus Projekten zur CO2-Abscheidung und geologischen CO2-Sequestrierung (CCS).

4 Das BAFU führt über die Ausstellung von Bescheinigungen und Emissionsrechten ein Protokoll in der Form einer elektronischen Datenbank.196
