Art. 116 Notification obligation and reporting

1 A borrower who has received a loan guarantee must inform the FOEN without delay during the duration of the guarantee about:

a.
changes that could have an effect on the guarantee;
b.
changes in contact information.

2 It must submit a report every quarter to the FOEN on:315

a.
the status of the guaranteed loans;
b.316
the course of business and its expected development; and
c.317
the liquidity and financial structure.

3 It provides the business report, balance sheet and statement of financial performance to the FOEN annually. These must be submitted no later than three months following their completion.318

Art. 115 Zusicherung der Bürgschaft

1 Das BAFU sichert der Darlehensnehmerin auf Gesuch hin die Gewährung der Bürgschaft zu, wenn die Anforderungen nach Artikel 114 erfüllt sind.

2 Das Gesuch um Zusicherung der Bürgschaft muss enthalten:

a.
Angaben über die Organisationsform und die Finanzstruktur der Darlehensnehmerin;
b.
eine technische Dokumentation des Projektes, inklusive Beschreibung der Anlagen und Verfahren, und von dessen geplanter Entwicklung und Vermarktung;
c.
eine projektbezogene Beschreibung des Geschäftsmodells;
d.
Angaben darüber, inwieweit die Anlagen und Verfahren den Anforderungen nach Artikel 114 genügen.

3 Das BAFU kann weitere Angaben verlangen, soweit es diese für die Beurteilung des Gesuchs benötigt.

4 Es kann in begründeten Fällen für die Zusicherung der Bürgschaft Sicherheiten einfordern.314
