1 Any person who wilfully obtains for himself or for another an unlawful advantage with regard to the levy , in particular by evading the CO2 levy or by obtaining an unlawful exemption from or distribution or refund of the levy, shall be liable to a fine not exceeding three times the amount of the unlawful advantage.
2 Attempts and complicity are offences.
3 Any person who obtains for himself or for another an unlawful advantage with regard to the levy through negligence shall be liable to a fine not exceeding the amount of the unlawful advantage.
1 Wer vorsätzlich sich oder einer anderen Person einen unrechtmässigen Abgabevorteil verschafft, namentlich die Abgabe hinterzieht, oder eine Abgabebefreiung, ‑vergütung oder ‑rückerstattung unrechtmässig erwirkt, wird mit Busse bis zum Dreifachen des unrechtmässigen Vorteils bestraft.
2 Versuch und Gehilfenschaft sind strafbar.
3 Wer durch fahrlässiges Verhalten sich oder einer anderen Person einen unrechtmässigen Abgabevorteil erwirkt, wird mit Busse bis zum Betrag des unrechtmässigen Vorteils bestraft.
